In response to the new rules issued Oct. 6, 2017, allowing certain employers to not provide coverage of contraceptive services or withdraw their accommodation, the Commonwealth of Pennsylvania filed suit challenging the new rules in the Eastern District of Pennsylvania. A Pennsylvania federal judge, on Dec. 15, 2017, issued a nationwide preliminary injunction preventing the federal government from enforcing the new rules; therefore, the new rules are no longer effective.
We will be watching this litigation and will let you know of further developments. Similar actions were brought separately by California, Delaware, Maryland, New York and Virginia, and rulings are expected soon in those cases, too.
